I (THE VOLUNTEER) hereby agree to the following terms and conditions regarding my participation in a scheduled performance with Mandy ALLFire, otherwise known as THE PERFORMER, and DAVIS / LEE PROJECTS, LLC otherwise known as HAUL GALLERY

  1. Conduct Agreement: I agree to not touch or interact with the performer without their advanced explicit permission in any way, with any part of my body. If any permission is given by the performer to touch or interact with them, it can be revoked at any time. I will not speak or act in a derogatory way towards the performer or Haul Gallery in any way. I will do whatever is asked of me throughout the duration of the performance, and not deviate from those requests in any way. If for any reason I do not want to or do not feel comfortable doing something, I will immediately cease participation and inform THE PERFORMER and/or HAUL GALLERY. 

  2. Communication Agreement: If I feel unwell, unsafe, or would like my participation in the performance to be over for any reason, I will immediately inform THE PERFORMER or HAUL GALLERY either verbally or with a signal previously agreed to with THE PERFORMER and HAUL GALLERY.

  3. Release of Liability: ​I recognize that there are certain inherent risks associated with participating in this performance, and assume full responsibility for personal injury to myself and further release and discharge ​THE PERFORMER and HAUL GALLERY ​for injury, death, loss of property, or damage to property, arising out of my participation in the performance, ​whether caused by the fault of myself, my affiliates, other third parties, THE PERFORMER or HAUL GALLERY. This agreement releases THE PERFORMER and HAUL GALLERY from all liability relating to injuries that may occur WHILE ON SITE AT 219 9TH STREET BROOKLYN, NY 11215. ​By signing this agreement, I agree to hold THE PERFORMER and HAUL GALLERY entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence. ​I agree that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in this activity. By signing below I forfeit all right to bring a suit against THE PERFORMER or DAVIS / LEE PROJECTS, LLC (HAUL GALLERY) for any reason. In return, I will be permitted to PARTICIPATE IN THE PERFORMANCE. ​I will also obey safety precautions as explained to me verbally. I will ask for clarification when needed. This Release shall be governed by New York State law. I hereby certify that I am over the age of eighteen, and that I have read, understood, and agreed to the foregoing. I will provide a valid state I.D. as proof of this.

  4. Video Release Agreement: I agreed to appear in a Video recording of the performance (THE VIDEO), and I understand that my voice and image will be recorded by various mechanical and electrical means of all descriptions. I hereby freely and without restraint consent to and give unto THE PERFORMER and HAUL GALLERY and their agents or assigns or anyone authorized by THE PERFORMER the unrestrained right in perpetuity to own, utilize, or alter THE VIDEO in any manner THE PERFORMER may see fit and for any purpose whatsoever, all of the foregoing to be without limitation of any kind. Without limiting the generality of the foregoing, I hereby authorize THE PERFORMER and grant unto them the unrestrained rights to utilize the Released Subject Matter in connection with the Video's advertising, publicity, public displays, and exhibitions. I hereby stipulate that THE VIDEO is the property of THE PERFORMER to do with as it will. I hereby waive to the fullest extent that I may lawfully do so, any causes of action in law or equity I may have or may hereafter acquire against THE PERFORMER or any of them for libel, slander, invasion of privacy, copyright or trademark violation, right of publicity, or false light arising out of or in connection with the utilization by THE PERFORMER or another of THE VIDEO. I expressly stipulate that THE PERFORMER may utilize THE VIDEO or not as they choose in their sole discretion without affecting the validity of this Release. I understand that I do not own any part of this video. I understand that THE VIDEO may be posted to websites and shared on social media platforms such as Instagram, Facebook, Reddit, Pinterest, Tumblr, Twitter, and any other similar platform not listed here. I also understand that videos taken by audience members (AUDIENCE VIDEOS) may also be posted to websites or shared on social media platforms like the ones listed above. All agreements and releases listed above apply to AUDIENCE VIDEOS, just as they apply to THE VIDEO.
